Terms of Service

These terms cover your use of BobtailMail — the API, the operator console, and the agent (MCP) surface. BobtailMail is operated by Ayudh Inc., a federal Canadian corporation based in British Columbia, Canada. By using the service, you agree to these terms.
What the service is
BobtailMail is a transactional email API: you send us a message via API call, we deliver it through our sending infrastructure, and we keep a durable record of what happened to it. Most messages are one-to-one, triggered by something a specific recipient did with your product — a purchase, a signup, an account event. We also support opt-in newsletters and editorial mail to a list a recipient explicitly subscribed to — see Acceptable use for what that requires. What we don’t support is unsolicited bulk mail: marketing to a purchased, scraped, or otherwise non-consenting list.
Your account
- You’re responsible for keeping your API keys and console password secure. Revoke a key immediately if you believe it’s been exposed.
- You must own or control any domain you register for sending, and complete the domain verification we require before we’ll send anything from it.
- You’re responsible for everything sent using your credentials, including by anyone or anything you gave them to.
Billing
BobtailMail is $15 per month, for up to 10,000 emails sent in that billing period. There is one plan — we don’t offer usage tiers or annual pricing. Payment is handled by a third-party payment processor; we never see or store your card details ourselves.
- If you send more than your plan’s cap in a billing period, further sends are refused until the next period starts.
- If a payment fails, sending is paused until you update your payment method from the billing portal in the console.
- You can cancel at any time from the billing portal. Cancelling stops future billing — you keep access through the end of the period you’ve already paid for.
- We don’t offer refunds for partial billing periods.
Acceptable use
Every message you send through BobtailMail must be to a recipient who has a real, existing relationship with you. That relationship is either an action this specific email is a direct response to (a purchase, a signup, an account event), or an explicit, confirmed opt-in to a newsletter or editorial list. An opt-in list only qualifies if:
- The recipient double-opted in — they requested the subscription, and confirmed it through a second, separate step (a confirmation click, not a pre-checked box).
- Every message carries a working one-click unsubscribe, and an unsubscribe takes effect immediately — no second email, no login required to confirm it.
- You keep a record of when and how each subscriber opted in. We may ask for it if a complaint rate suggests a list wasn’t genuinely opt-in.
You may not use the service to send, or to help anyone else send:
- Unsolicited bulk email — marketing to a purchased, scraped, rented, or otherwise non-consenting list, or anything a reasonable recipient would call spam.
- Phishing, malware, or content that misrepresents its sender or origin.
- Content that is illegal, fraudulent, or infringes someone else’s rights.
- Mail to an address that has previously bounced or complained through your account — our system enforces this automatically and will refuse the send.
- Mail to a list acquired through a merger, acquisition, or a change in a company’s privacy policy after the fact — opt-in doesn’t transfer with a purchased list or a reinterpreted old one.
We monitor bounce and complaint rates because a single shared sending infrastructure means one customer’s bad traffic can affect deliverability for everyone else on it. We may suspend or restrict sending on an account with a bounce or complaint rate that puts that infrastructure at risk, and we may permanently suspend an account for the violations listed above.
For the avoidance of doubt: you, not BobtailMail, are the sender of the messages you submit through our API, for the purposes of Canada’s CASL, the U.S. CAN-SPAM Act, and any similar law. You are responsible for your own compliance with the laws that apply to your email — we don’t provide legal advice, and this page isn’t a substitute for your own review of what applies to you.
Availability
We work to keep the service reliable, but we don’t currently offer a guaranteed uptime commitment or service credits. We’ll tell you about planned maintenance where we reasonably can.
Termination
You can stop using the service and close your account at any time. We may suspend or terminate an account that violates these terms, with notice where the situation allows it — immediately, without notice, where it doesn’t (an active abuse or security issue, for example).
Disclaimer and limitation of liability
The service is provided “as is,” without warranties of any kind. To the extent the law allows, we aren’t liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
Changes
We may update these terms as the service changes. We’ll update the date at the top of this page when we do; continued use after a change means you accept it.
Governing law
These terms are governed by the laws of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
